Zendacare Terms of Service

Welcome to Zendacare! These Terms of Service (“Terms”) govern your access to and use of Zendacare’s services, including our mobile application, website, and any related services (collectively, the “Services”). By using the Services, you agree to be bound by these Terms. If you do not agree, you should not access or use the Services.

1. Acceptance of Terms

By registering for or using the Services, you confirm that you:

  • Are at least 18 years old (or the legal age of majority in your jurisdiction).
  • Have read, understood, and agreed to these Terms.
  • Have the authority to enter into this agreement on behalf of yourself or the entity you represent.

2. Description of Services

Zendacare provides a digital platform that connects users with healthcare providers, facilitates appointment scheduling, stores medical records, offers telemedicine consultations, and provides other healthcare-related services. Zendacare does not provide medical services directly and does not replace professional healthcare providers.

3. Account Registration and Responsibilities

3.1 Account Creation

To access certain features, you may need to create an account. When registering, you must provide accurate, complete, and updated information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Security

You are responsible for all activity on your account. If you suspect unauthorized access, notify Zendacare immediately. Zendacare is not liable for losses resulting from unauthorized use of your account.

3.3 Account Termination

Zendacare reserves the right to suspend or terminate your account if:

  • Violate these Terms.
  • Provide false or misleading information.
  • Engage in fraudulent or harmful activities.

4. User Conduct and Responsibilities

By using Zendacare’s Services, you agree NOT to:

  • Use the Services for any unlawful, fraudulent, or abusive purpose.
  • Impersonate another person or misrepresent your affiliation.
  • Disrupt, interfere with, or damage the operation of the Services.
  • Upload or share false, misleading, or inappropriate content.
  • Violate any applicable laws or regulations.

Zendacare reserves the right to investigate and take appropriate legal action against any misuse of the Services.

5. Medical Disclaimer

5.1 No Medical Advice

Zendacare is NOT a healthcare provider and does NOT offer medical advice, diagnosis, or treatment. Any information available on the platform is for informational purposes only and should not replace professional medical consultation. Always consult a licensed healthcare provider for medical concerns.

5.2 Telemedicine Services

If you access telemedicine services through Zendacare, you understand that:

  • Any healthcare advice comes from independent medical professionals, not Zendacare.
  • Zendacare does not control or endorse the opinions of healthcare providers.
  • You assume full responsibility for decisions made based on consultations.

6. Payment, Fees, and Subscription Plans

6.1 Payment Terms

Some Zendacare features may require payment. By making a payment, you agree to the pricing, billing, and refund policies specified at the time of purchase.

6.2 Subscription Plans

If you subscribe to a paid plan, it will automatically renew unless canceled before the renewal date. You authorize Zendacare to charge your selected payment method for recurring payments.

6.3 Refund Policy

Payments are generally non-refundable, except as required by law or at Zendacare’s discretion. If you experience billing issues, contact Zendacare Support.

7. Third-Party Services and Content

Zendacare may provide access to third-party healthcare providers, pharmacies, payment processors, and other external services. You acknowledge that:

  • Zendacare is not responsible for third-party content, services, or conduct.
  • Use of third-party services is at your own risk and subject to their terms.

8. Privacy and Data Protection

Your use of Zendacare is also governed by our Privacy Policy, which explains how we collect, use, and protect your data. By using the Services, you consent to Zendacare’s data practices.

9. Intellectual Property Rights

9.1 Zendacare’s Ownership

All trademarks, logos, software, and content provided by Zendacare remain the exclusive property of Zendacare or its licensors. You may not copy, modify, or distribute any part of Zendacare’s intellectual property without permission.

9.2 User-Generated Content

If you post content (such as reviews or comments) on Zendacare, you grant Zendacare a non-exclusive, royalty-free, worldwide license to use, reproduce, and distribute your content for promotional and service-related purposes.

10. Service Availability and Modifications

10.1 No Guaranteed Availability

Zendacare strives to provide reliable Services but does not guarantee uninterrupted or error-free operation. Zendacare may suspend, modify, or discontinue any part of the Services at any time.

10.2 Updates and Changes

Zendacare may update these Terms from time to time. If changes significantly affect your rights, we will notify you via email or the App. Your continued use after updates signifies your acceptance.

11. Limitation of Liability

11.1 No Indirect Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZENDACARE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF THE SERVICES.

11.2 Maximum Liability

ZENDACARE’S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU (IF ANY) FOR ACCESSING THE SERVICES IN THE PAST SIX MONTHS.

12. Indemnification

You agree to indemnify and hold Zendacare, its affiliates, and its officers harmless from any claims, liabilities, damages, losses, or expenses arising from your violation of these Terms or misuse of the Services.

13. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.

13.1 Dispute Resolution
